In 2007 and 2008, ICE's Fugitive Operations Teams conducted controversial home raids throughout the tri-state area. In response to this and other questionable conduct, advocates have been challenging whether ICE can use evidence it illegally obtained and demanding access to documents. This interactive workshop will cover advanced immigration court strategies to obtain documents and to challenge evidence the government obtains through illegal raids, searches, and coercive interrogations. Document requests are critical in a wide range of cases, not just after illegal raids. The workshop will cover the Ninth Circuit's decision of Dent v. Holder, document requests, suppression motions and termination motions for illegal government conduct. The co-presenters have hands-on experience at the immigration court, BIA, and circuit court levels. The co-presenters are Heather Yvonne Axford, Staff Attorney at Central American Legal Assistance and Rex Chen, Managing Attorney at Catholic Charities of the Archdiocese of Newark.

  • CLE Credit Comments: Although the subject matter is advanced, the workshop will be useful for beginners. CLE credit: 2.5 credits in skills. This course provides transitional credit for newly admitted attorneys and non-transitional credit for experienced attorneys.
