Victims of intimate partner violence and other crime victims are particularly vulnerable to misuse of credit and identity theft because their abusers often have easy access to confidential information such as their Social Security Number, passwords, bank and credit card accounts, and more. Abusers may use this information to steal bank funds or open credit cards or lines of credit in the survivors' or their children’s names. Debt from this fraudulent activity can impact a victim’s financial stability and independence, as well as destroy their credit history for years. Yet many practitioners are unaware of powerful federal protections available to these victims, such as the Fair Credit Reporting Act, The Electronic Funds Transfer Act and the Fair Credit Billing Act.   Our focus will be on how these and other similar statutes can be used to force financial institutions and credit reporting agencies to reimburse victims for a wide variety of damages.

Dan is the Managing Partner at Schlanger Law Group, LLP, where he has built a federal litigation practice dedicated to representing victims of inaccurate credit reporting and identity theft.
