Like all students, students with disabilities must have the opportunity to fully and equally participate in our public schools. The ability to communicate is critical to participation. This program will focus on the obligations of public schools, including charter schools, under Title II of the Americans with Disabilities Act (ADA) and the Individuals with Disabilities Education Act (IDEA) to meet the communication needs of students with hearing, vision, or speech disabilities.
Our panel of experts will discuss:
- The requirements under the ADA and IDEA, the differences between these laws, and how they interact
- Case law, including the seminal K.M. v. Tustin Unified School District case
- The joint guidance on effective communication by the U.S. Departments of Justice and of Education
- Hypotheticals illustrating the proper application of the IDEA and Title II
