The Practising Law Institute is offering a free webcast of a live presentation from San Francisco entitled Seeking Safety in America: The Nuts and Bolts of Representing Domestic Violence Victims as Respondents in International Child Abduction Cases 2015 on July 29, 2015 at 12:00 Noon Eastern.

Battered parents are sometimes forced to flee with their children across international borders, seeking safety in the United States. Their abuser, the left-behind parent in these cases, may file a petition under the Hague Convention on the Civil Aspects of International Child Abduction for the return of the children. These cases are filed in U.S. courts, with resources focused on the prompt return of children wrongfully removed from their habitual residence. However, resources for battered parents in these cases remain limited.

This training is designed to prepare attorneys to represent battered parents in Hague Convention cases by providing attorneys a basic understanding of the Convention and how the Convention intersects with domestic violence. This program will also focus in on the mechanics of proving the Article 13(b) defense and the role of pro bono attorneys in these cases.

What You Will Learn
  • Hague Convention overview and basics
  • Impact of exposure to domestic violence on children
  • Best evidence under the grave risk defense
  • Best practices in preserving the record for appeal
  • Pro bono representation and the “best interest” of the client
Who Should Attend
