Despite the inference in the designation, 501(c)(3) tax-exempt entities are not fully exempt from taxation. In fact, there are many taxes they may be subject to and the failure to understand and obey the tax rules can be devastating for an unsuspecting charity. This interesting and informative program will educate non-tax lawyers who represent tax-exempt organizations pro bono about the taxes that affect their clients' day-to-day operations, including the tax on unrelated business income, employment, property, sales and use, and excise. Participants will gain a basic understanding of these taxes in order to assist their pro bono clients in identifying and avoiding potential pitfalls. For attorneys representing Pro Bono Partnership of Atlanta clients, once they spot a potential tax issue, they can then refer their clients back to the Partnership for expert tax assistance. Paralegals may volunteer for the Partnership but are responsible for finding a trained attorney with whom to work.
